Courting Justice is a documentary film about the role of women in building a human rights based democracy; South Africa is the democracy in question. The judiciary, the film makers argue, have a key role to play in 'living the dream' and of making that democracy happen. The role of women as members of the senior judiciary is the particular concern of this film. Courting Justice offers an intimate and revealing portrait of a number of women who at the time the film was made (2007-8) held high judicial office across the range of the superior courts in South Africa, from the Constitutional Court in Johannesburg to various High Courts. Through these lives the film's 70 minutes (and there is also a shorter 54 minute version) present the arguments for judicial gender diversity, explores some of the challenges to and considers the future facing the women who have taken on, and who might in the future participate in, the important political role of being a judge.

Early in the course of undertaking empirical research on the sexual diversity of the judiciary I had to address a particular challenge. Sexuality, I was repeatedly told, is not and ought not to be a difference that is taken into account. At best it ought to be disregarded or taken out of consideration. This generated a number of challenges for my research. How do you research and make sense of sexuality as a difference that key informants assert is absent or seek to make invisible and irrelevant? How do you research the operation and effects of that which is not to be spoken about? How do you research the sexual norm when its existence and operation is denied? This article explores one response. It is a project that may for some be surprising and unexpected. It is a study of judicial portraits. Drawing on the insights of queer theory and art historical scholarship on portraits I undertake a textual analysis of these images, focusing upon the aesthetic and artistic traditions used to make them. A small case study of portraits of the Chief Justices of the Supreme Court of New South Wales is used to explore how, if at all, sexuality figured in these portraits

Various law and film scholars have noted that the judge occupies the place of a marginal figure in 'legal cinema' and in related scholarship. In this chapter I want to engage with the debate about the representation of the judge in film by way of an examination of a South African documentary, 'Two Moms: A family portrait' (2004). In the first instance this 'family portrait' appears to be neither an obvious candidate for inclusion in the canon of 'legal cinema' nor a film with a plotline dominated by a judge. But from this rather unpromising start this chapter explores how a film about an ordinary family made up of extraordinary people is an extraordinary film about law in general and about the figure of the judge in particular. The interface between an institution concerned with the administration of justice (the London Police Dept) & the body is examined, using as points of departure a London map used to investigate sex-related offenses (homosexuality & prostitution) & a London police report on plainclothes officers' surveillance of public lavatories. These documents present law as a cartographic technology that produces a spatial order for law & a set of practices of the body as legal technique. The map portrays the landscape of bodily perversion in London. Policing is accomplished with the visible body as agent, or the invisible body in the case of surveillance. When policing a public urinal, the public/private nature of this space & the corporeal practices generating the space are ambivalent. 23 References. M. Pflum
